The present General Sales Conditions detailed below (hereinafter referred to as "general conditions") exclusively determine the contractual relationships between every customer who uses the Cosmetikke website (hereinafter referred to as "user") and Cosmetikke - Smart Beauty, whose headquarters are located in Rua Pedro Nunes, Bloco C, 3030-199 Coimbra, Portugal. The company is registered at the Commercial Registry Office of Vila Nova de Gaia Taxpayer Number 515 957 577 (hereinafter referred to as « Cosmetikke »).

The general conditions of sale are the only ones that apply and supersede all other conditions, except prior agreement, express and in writing. Cosmetikke may occasionally modify certain provisions of its general conditions, and it is also necessary that this is re-read each time you visit the Cosmetikke website (hereinafter referred to as the "Site"). We consider that when the order is validated, the customer is automatically accepting our general conditions of sale.

By connecting to the site, the customer undertakes to respect the General Conditions as well as the Conditions of Use.

Information about the products

Always read carefully the instructions for use of each product, and in case of doubt, use the contact form or our chat before any use.

The photographs that illustrate the products do not enter into the contractual field and do not replace any commitment on the part of Cosmetikke. On the other hand, with regard to the technical sheets and product descriptions of our partners or suppliers, Cosmetikke declines all responsibility for the validity of their content.

The accessories that come in the packs sold by Cosmetikke may be accessories from compatible brands and not necessarily from the brands of the equipment manufacturers.

 

Prices

The sale prices indicated on the website are in Euros, with taxes and fees included. Shipping costs are borne by the customer and are charged at the end of the order, depending on the products selected and their weights.

Note that, for the European Union, prices appear in Euros on the website, but also in the currency of the country of dispatch for information, without, however, having any contractual value.

Cosmetikke declines all responsibility in case of error or inaccuracy in the conversion system used, or any difference that may arise between the estimated total value of the order and the invoice amount in euros.

Cosmetikke reserves the right to modify prices at any time, however it tries to apply the rates in force that were indicated on the website at the time the customer places the order.

We inform you that, if the indicated price is incorrect and is manifestly derisory, regardless of its cause (computer bug, manual error, technical error, etc.), the order will be canceled, even if it has already been confirmed and paid.

 

Stock and availability

Cosmetikke respects the deadlines for sending an order as long as there is availability of stock.

In the event that one of the ordered products is not available in stock, Cosmetikke will contact the customer by email or by telephone within a maximum period of 15 days from the date of order, in order to inform the new delivery deadline. of the product. However, if one of the ordered products is unavailable, Cosmetikke undertakes to send the available products and offers the "delivery fee" of the remainder of the order if the missing product is unavailable for an indefinite period.

Cosmetikke asks the customer to choose, in place of the unavailable product, a product with equivalent quality and price. In case of refusal by the customer, Cosmetikke will refund the full amount of the product.

 

Delivery Methods

Products purchased on the Site are delivered to Mainland Portugal and the Islands via CTT, a courier with Express Service. Cosmetikke does not deliver to PO Boxes. The order will be delivered to the address specified by the customer at the time of purchase.

The contribution for transport, as it is added to the price of the products purchased, will be calculated automatically by the system. In case of non-receipt of the order within the indicated deadlines, an investigation will be carried out with the carrier, which may take a few days. The Customer should contact the Cosmetikke Customer Service and during this period no refund can be made, as the loss of the order will have to be verified and confirmed.

The customer will have 24 hours after receiving the order to complain to our Customer Support Service by calling +351 239 090 867 any anomaly with the same. Cosmetikke is not responsible for any problems arising from transport. Cosmetikke will be obliged to refuse any request for reimbursement or replacement (right of withdrawal) for products that present external defects and that a claim has not been made within 24 hours. The right of withdrawal remains valid for cases of technical problems that are detected by the customer after delivery and in accordance with the terms provided by law.

What to do at the time of delivery:
1 . Check that the packaging is in perfect condition.
2 . Check that the product complies with the order made and that it has no visible defects.

Shipping costs are borne by the customer and are calculated automatically before the user completes the order, taking into account the products and their weights or volumetric weights.

When finalizing the order, the customer accepts the values previously calculated and presented for the shipping costs.

Prices with VAT included at the legal rate.

 

Delivery deadlines

How long does it take for my purchase to arrive?

Delivery times vary depending on the shipping method selected

📦 Home delivery: Between 1 to 3 business days* for Mainland Portugal and between 3 to 8 days for other EU countries.
* For Azores and Madeira, add between 5 to 10 working days to the mentioned deadlines.


After making the payment, the shipping time is up to 2 business days.

Attention : Shipping times may be slightly delayed in peak periods such as: Black Friday, Christmas, Fairs or Bombastic. In these periods, exceptionally, exchanges or returns can only be made after receiving the order.

Secure payment

Cosmetikke has chosen to ensure its payments with partners that guarantee that they are safe, encrypting the connection for network transactions.

 

Right of free resolution, satisfied or refund

Within a maximum period of 14 days after receiving the order, the customer has the right to terminate the contract.
The costs of shipping the product for return will be the responsibility of the customer.
The customer can be held responsible for the depreciation of the good, if the manipulation carried out to inspect the nature, characteristics and functioning of this good exceeds the manipulation that is usually allowed in a commercial establishment.

Products excluded from the right of legal withdrawal:

  • Incomplete, damaged or used products by the customer;
  • Supply of goods made according to customer specifications or clearly customized;
  • Supply of sealed goods not subject to return, for reasons of health protection or hygiene when opened after delivery.

In case of exercising the right of withdrawal, Cosmetikke will do its best to reimburse the customer quickly (by the same payment method), noting, however, that this period will depend on the technical evaluations that will be carried out on the material, with a maximum duration of 15 days (counted on arrival at Cosmetikke).

The guarantee does not apply to problems resulting from causes external to the product (for example: accident, shock, lightning, a power outage...), from use or installation not in accordance with the manufacturer's specifications or from use that is detrimental to good conservation. of product.

 

Exchange or return

To exchange an item, the customer can do so in two ways:

Contact our customer service, using the telephone number or email. Shipping charges are borne by the customer (the product travels under his/her responsibility).

Go to any of our stores, accompanied by the invoice and make the return directly, without having to contact the online store in advance. In this case, the return will be subject to verification of the conditions of the article by the employee.

The exchange or return of an article must comply with the following conditions:

  • Not having exceeded 14 days after purchase
  • Presentation of the invoice or purchase receipt.
  • The item has not been used and is returned in the same condition in which it was purchased, that is, with the original packaging intact, accompanied by the respective accessories, manuals and offers.
  • Refunds are always made using the same payment method as the purchase.

We do not exchange used, unsealed products, scissors, hygiene items, furniture/catalogue items, personalized items or items that are in poor condition.

In the event of a defect or non-conformity of a product or equipment, the exchange may be subject to prior evaluation and analysis by the official technical assistance of the brand.

 

Product warranty

The products for sale on the site are covered by various types of commercial guarantees defined below. The customer's subscription to these commercial guarantees does not preclude the application of the legal guarantee of compliance in the following legal conditions for any material sold by Cosmetikke on the website, whether new or second-hand.

By applying the legal guarantee of conformity, Cosmetikke undertakes to deliver your order in accordance with the established sales contract and to correct any defects in conformity found at the time of delivery.

To comply with the contract, the products must:
1) correspond to the description on the website when ordering;
2) be recommended for the use for which products of the same type are normally intended or any other type of special use sought by the customer, having been informed by Cosmetikke before placing his order and that it has been formally accepted;
3) present the usual quality and features of a product of the same type expected by any consumer, taking into account the nature of the product and the characteristics described on the website.

If there is a defect in conformity, the product will be brought into conformity, without any cost to the customer.

We remind you that any conformity defect found within a period of 3 years from the delivery of your order is covered by this legal guarantee.

In addition, we remind you that the legal guarantee may not be applied or be partially applied in some cases such as:
- repairing damage resulting from a cause external to the device (eg accident, shock, current fluctuation, oxidation, presence of sand...);
- the customer's liability resulting, for example, from use or installation not complying with the manufacturer's specifications;
- use harmful to the maintenance of the appliance;
- any defect in conformity known to the customer at the time of ordering.

Warranty application periods (electrical equipment)

End Consumer: The warranty period for equipment is 36 months
Companies or professionals: The equipment warranty period is 6 months in accordance with nº 2 of article 921 of the Civil Code.
In several equipments, the warranty period for professionals has been extended by the supplier at no cost to the customer - see the complete list of warranty periods here .

These warranty periods do not apply to consumables, components and accessories of the products, which will have the warranty referred to by the respective manufacturers.

CLARIFICATION:

The Consumer Protection Law – Law no. 24/96, of 31 July – defines consumer as anyone to whom goods are supplied, services rendered or transmitted any rights, intended for non-professional use. That is, that does not obtain any financial advantage in the purchase or use of the product or good.

under warranty

Repairs to equipment under warranty must be carried out within a maximum period of 30 days.
The analysis and technical assistance is provided by the representatives of the brand itself.
If the anomaly detected is not covered by the warranty (see manufacturer's conditions) the amount charged for the repair will be borne by the customer, if he chooses to do so.
In this case, a quote for the repair will be sent to the customer, which will only be carried out after approval by the customer and with the customer's written authorization.
If the customer does not authorize the repair and refuses the proposed quote, he will be subject to an analysis fee of €15. (VAT Inc.)
The guarantee does not apply to problems resulting from causes external to the product (for example: accident, shock, lightning, a power outage...), from use or installation not in accordance with the manufacturer's specifications or from use that is detrimental to good conservation. of product.
Therefore, we recommend consulting the user manual supplied with the products and the exact conditions of the manufacturer's guarantees.
In any case, Cosmetikke is not responsible for the non-application of the warranty by the manufacturer for the reasons described above.
For the period covered by the warranty, the customer must return it directly to the Cosmetikke After-Sales Service (SPV) or to one of our stores.

Out of warranty
For equipment outside the legal warranty period, the repair will always be subject to analysis and budget and will only be carried out after written approval of the proposed budget.
Upon delivery of the equipment for assistance, a shipping fee of €15 (VAT Inc.) will be charged.
- Refundable and deductible from the total repair price
- Non-refundable if the quote is not accepted or if the product is irreparable

Abandoned Equipment:
As soon as the equipment becomes available in store, you will receive a notification by SMS or email to proceed with its collection, within a maximum period of 90 days.
If the collection is not carried out within the defined period, the equipment will be considered abandoned and sent to the recycling center for slaughter, and the right to reimbursement of any amount paid will be revoked.

All content on the Cosmetikke Site (illustrations, texts, titles, brands, images, videos) is the property of Cosmetikke, its co-contractors or partners. The partial or total reproduction of the content through any procedure and in any support is subject to the prior and express authorization of Cosmetikke. All information, content, documents and software offered by our services are protected by Portuguese and international legislation, with regard to intellectual property and copyright. Cosmetikke cannot authorize the copying, presentation or distribution of contents for which you do not have the intellectual property rights. Any fraudulent use of the rights obtained by third parties constitutes a crime of counterfeiting, severely sanctioned by the Intellectual Property Code. Cosmetikke will not be responsible, in any way, for the violation of a user's rights obtained by third parties and perpetrated by the latter's activities on the site.
